Fair Credit Reporting Act Cases

Because of the prevalance of identity theft and other credit report problems, the lawyers of Baxter & Baxter, LLP, have specialized in litigating Fair Credit Reporting Act cases. These include cases against the "Big Three" credit reporting agencies (Equifax, Experian & Trans Union), as well as "furnishers of credit information". These cases often arise out of identity theft or false credit reports.

Unlawful Debt Collection Cases

Agressive debt collection agencies have actively pursued consumers in Oregon. Sometimes these calls and letters are for debts that the individual does not even owe! Even when the debt is owed, the debt collector cannot lie to, harass, or abuse a consumer. In some cases, the collection agencies report false information to the credit reporting agencies, compounding the problem of false credit reports.

Credit Reporting and Debt Collection Cases after Bankruptcy

The attorneys of Baxter & Baxter, LLP, have also observed an increase in the number of credit reporting and unlawful debt collection cases arising after bankruptcy. Bank mergers and acquisitions contribute to false information being reported the the credit reporting agencies, and can result in collection calls and letters for discharged debts. This website contains specific information about disputing false credit reports.

  • Credit Reporting Problems

Cases involving false credit reports, inaccurate account information, etc. These include identity theft and fraudulent accounts (fraud), or accounts belonging to another person with similar names or other identifiers (mixed file). These cases also include accounts with inaccurate balances, amounts due, or other derogatory information. These cases also include accounts which are over the obsolescence period (seven years in most cases).

  • False Credit Reports & Inaccurate Credit Reports

Disputed information in false credit reports is not deleted or updated with accurate information. These cases can include problems obtaining credit reports, contacting credit reporting agencies, or disputing credit report inaccuracies. These cases can also deal with creditors inaccurately reporting accounts. These cases can often overlap with unlawful debt collection cases.

  • Identity Theft & Fraudulent Accounts

Accounts belonging to another person, or opened fraudulent by an impostor appear on your credit report. Identity theft is among the fasted growing crimes in this country. It often hits home when innocent consumers are hit with collection calls and letters, or even lawsuits for bills they do not owe. These accounts can also come to a consumer's attention when they are in the process of seeking credit and they pull a credit report.

  • Inaccurate Credit Reports after Bankruptcy

Discharged accounts show false balances or amounts past due. Joint accounts discharged in one spouse's bankruptcy may appear as a bankruptcy in the non-filing spouse's credit report. Accounts may falsely be listed as charge-offs or other derogatory status codes. Accounts may have a false date of last activity, causing otherwise obsolete information to appear.

  • Unlawful Debt Collection

Debt collectors pursue consumers for debts not owed. These cases are particularly prevalent with the increasing epidemic of identity theft. Consumers may not even be aware of debts until they are sued or until they apply for credit and see the false accounts on their credit report.

  • Debt Collector Harassment

Debt Collectors are deceptive, harassing, or abusive to the consumer. Collectors generally cannot threaten physcial harm, criminal prosecution, or seizure of property without disclosing the legal steps required to take such action. Collectors also cannot call repeatedly or at inconvenient times of the day.

  • Consumer Fraud

Businesses engage in false or misleading conduct. This includes bait and switch, and misrepresentation of condition, quality, and benefits. This can also include misrepresentations about price, cost, or warranty coverage.

  • Unfair Trade Practices & Unlawful Trade Practices

Businesses engage in prohibited business conduct. Such conduct can include misrepresentation of prior damage, misrepresentation of source, sponsorship, or ownership. Such conduct can also include failure to disclose known defects.
